01What Janette Is
Janette ("Janette," "we," "us") is software that helps contractors and trade professionals run the back office of their business — quoting jobs, sending invoices, tracking who owes them money, scheduling, and managing crew — primarily through text message. By creating an account or using the service, you ("you," "Contractor") agree to these Terms.
Janette is a software tool, not a party to your jobs. We are not a contractor, builder, lender, bank, or payment processor. We do not perform work, guarantee outcomes, or become a party to any contract between you and your customers. Estimates, proposals, and pricing suggestions are tools to assist you — you are solely responsible for the figures you send and the work you perform.
02Accounts & Eligibility
You must be at least 18 years old and authorized to act on behalf of the business you register. You are responsible for the activity on your account and for keeping your phone number and login details secure. The account is intended for a single contractor; reselling or sharing access is not permitted without our written consent.
03Subscription, Billing & Auto-Renewal
Janette is offered as a paid subscription, billed monthly or annually at the prices shown at sign-up. New accounts may include a 14-day free trial. If you do not cancel before the trial ends, your paid subscription begins automatically.
Automatic renewal. Your subscription automatically renews at the end of each billing period (monthly or annual) at the then-current price, and your payment method is charged, until you cancel. We will send a renewal reminder before each charge. You can cancel anytime by replying STOP or CANCEL by text, or by contacting support — cancellation takes effect at the end of the current period.
Except where required by law, payments are non-refundable. We may change subscription prices with advance notice; changes apply to the next billing period.
04Text Messaging (SMS)
Janette works by text. By providing your mobile number and starting an account, you consent to receive recurring account, service, and transactional text messages from Janette at that number, including messages sent by automated systems.
- Message frequency varies based on your activity.
- Message and data rates may apply from your carrier.
- Reply STOP to opt out at any time, and HELP for help.
- Carriers are not liable for delayed or undelivered messages.
Consent to service messages is part of using Janette. We will not use your number for unrelated marketing without separate, clearly disclosed consent that is not a condition of purchase.
05Payments & Stripe
All payments are processed by Stripe, our third-party payment provider. Your card details are collected and stored by Stripe under its own terms and security standards — Janette does not collect, see, or store your full card number. Your use of payment features is also subject to Stripe's terms and privacy policy.
06Customer Invoice Payments
When your customer pays an invoice through a Janette payment link, that payment is processed by Stripe and routed directly to you (the Contractor) through Stripe's connected-account platform. Janette does not take custody of, hold, or control those funds. The Contractor is the merchant of record for customer payments and is responsible for the underlying goods and services, refunds, chargebacks, and any disputes with the customer.
To receive customer payments, you must complete Stripe's onboarding and identity verification. We may charge a platform or transaction fee, disclosed before you enable payments.
07Acceptable Use
You agree not to use Janette to: break the law; send unlawful, deceptive, or harassing messages; infringe others' rights; upload malicious code; attempt to disrupt or reverse-engineer the service; or send communications to people who have not consented to receive them. You are responsible for complying with messaging, consumer-protection, licensing, tax, and contractor-licensing laws that apply to your business.
08Your Data & Ownership
Your business data is yours. You retain ownership of the jobs, customers, invoices, files, and other content you put into Janette. You can export your data at any time, including QuickBooks-ready files. You grant us a limited license to host, process, and display that data solely to provide the service to you. Our handling of personal information is described in our Privacy Policy.
09Intellectual Property
Janette, including its software, design, and brand, is owned by us and protected by intellectual-property laws. These Terms do not transfer any ownership of Janette to you; you receive a limited, non-exclusive, non-transferable right to use the service while your account is active and in good standing.
10Disclaimers
Janette is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or that estimates, pricing, or financial figures it generates are accurate or suitable for any particular job. Janette does not provide legal, tax, accounting, or professional advice. You are responsible for reviewing every quote, invoice, and figure before relying on or sending it.
11Limitation of Liability
To the fullest extent permitted by law, Janette and its owners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising out of or related to your use of the service. Our total liability for any claim will not exceed the amount you paid us in the [12] months before the claim. [Bracketed cap subject to counsel review.]
12Indemnification
You agree to indemnify and hold Janette harmless from claims, damages, and expenses arising from your use of the service, your work and contracts with your customers, the messages you send, or your violation of these Terms or applicable law.
13Dispute Resolution
[Placeholder — to be finalized by counsel.] These Terms contemplate that disputes will be resolved through [binding arbitration / the courts of [jurisdiction]], and may include a class-action waiver where enforceable. The mechanism, venue, and any consumer carve-outs must be drafted and reviewed by a lawyer before launch.
14Termination
You may stop using Janette and cancel at any time. We may suspend or terminate your account if you violate these Terms, fail to pay, or use the service in a way that creates risk or legal exposure. On termination, your right to use the service ends, but you may export your data for a reasonable period as described in our Privacy Policy.
15Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you (for example, by text or in-app) before they take effect. Continuing to use Janette after changes take effect means you accept the updated Terms.
16Contact & Governing Law
These Terms are governed by the laws of [state/jurisdiction], without regard to conflict-of-laws rules. Questions about these Terms? Contact us at support@getjanette.com or by text at +1 (775) 347-6876.
